Recommendations
The recommendations of the CUII review committee published on this page are only part of the two-step review process. The basis for any DNS-block is firstly the examination by the CUII's independent review committee and the subsequent recommendation. Secondly, this recommendation is checked by the state-run German Federal Network Agency for Electricity, Gas, Telecommunications, Post and Railways (Bundesnetzagentur – BNetzA). The Federal Network Agency issues a declaration of no objection as the competent technical authority under the EU Net Neutrality Regulation (Regulation (EU) 2015/2120) if it too is of the opinion that the recommended block is lawful. The CUII procedure thus performs an important resolving role for the limited area of clear cases of structurally copyright-infringing websites. The CUII review panel makes its recommendation independently. Neither for the copyright holders nor for the internet access providers does the recommendation of the review panel imply an acknowledgement or agreement with regard to the legal considerations or the underlying legal basis. Copyright holders and internet access providers reserve their respective legal positions.
